1. Scope
These General Terms and Conditions (AGB) apply to all rental agreements between BOSU GmbH, FN 587756 y, Hörlgasse 5/2, 1090 Vienna, Austria (hereinafter “Landlord” or “Dwell Bell”) and tenants (hereinafter “Guests”) who book an accommodation for short- or medium-term use.
By making a booking through our website, by email, or through a third-party booking platform (Booking.com, Airbnb, Marriott, or similar), the Guest agrees to these Terms and Conditions.
Where bookings are made via third-party platforms, the respective platform’s terms may also apply. In case of conflict, the terms of the specific booking confirmation shall prevail.
2. Rental Properties and Purpose
All accommodations are provided for residential use only. Commercial use is not permitted without prior written approval.
For medium-term stays (up to 6 months), the rental relationship is established solely as a secondary residence in accordance with § 1 para. 2 no. 3 MRG (Mietrechtsgesetz). Main residence registration is not permitted.
2.1 Registration Duty
Important: Under Austrian law (Meldegesetz), guests are legally required to register with the authorities for stays exceeding 3 days. For stays longer than 2 months, additional obligations may apply (e.g. secondary residence registration, residence permit). Guests are solely responsible for complying with all applicable registration duties.
3. Booking and Payment
- Bookings may be made via our website (dwellbell.at), by email, or through third-party platforms (Booking.com, Airbnb, Marriott).
- A booking is only considered binding upon written confirmation by BOSU GmbH.
- Accepted payment methods: credit card (via Stripe) and bank transfer.
- Booking acceptance is subject to the availability of the selected accommodation and payment of the required deposit.
3.1 Medium-Term Payment Terms
For bookings exceeding 30 nights, BOSU GmbH reserves the right to charge either the total rental amount in advance or to arrange monthly partial payments. The specific payment plan will be confirmed upon booking.
4. Rental Period
- Minimum stay: 2 nights.
For medium-term stays, the rental period may not exceed 6 months. There is no automatic renewal — a new agreement must be arranged.

Rental prices are charged per night or per month, regardless of actual arrival time. Early check-in or late check-out may be arranged at the time of booking, subject to availability. A fee of €25 may apply.
6. Included Services
Included in the rental price:
- Electricity, water, heating
- Bed linen and towels
- Wi-Fi and TV
- Final cleaning
- Basic consumables (soap, shampoo, shower gel, tea, coffee)
- Local authority taxes
Not included:
- Personal food and beverages
- Laundry services
- Personal care products (toothpaste, toothbrush, etc.)
7. Security Deposit
- A security deposit is required before arrival. The amount depends on the specific accommodation and will be communicated at the time of booking.
- The deposit covers potential damage, lost keys, excessive cleaning, or other charges arising from the Guest’s stay.
- The deposit may be charged to the Guest’s credit card or paid in cash upon arrival.
- The deposit will be refunded within 14 business days after proper check-out, subject to property inspection.
- If damage exceeds the deposit amount, the Guest will be invoiced for the additional costs within 5 business days of departure.
Guests are asked to notify Dwell Bell of any damages or breakages that occur during their stay as soon as possible.
8. Cancellation Policy

Additionally, a non-refundable administrative fee of €100 is charged for every cancellation.
Note: Different cancellation rules may apply for bookings made through third-party platforms (Booking.com, Airbnb, Marriott). The cancellation policy of the respective platform shall apply in such cases.
9. Maximum Occupancy
The number of guests may not exceed the maximum capacity stated on our website or in the rental agreement for the specific property. In case of violation, BOSU GmbH reserves the right to terminate the agreement immediately without refund.
10. House Rules and Quiet Hours
- Smoking: Strictly prohibited in all properties. Penalty: €300.
- Parties and events: Strictly prohibited in all properties. Penalty: €2,000. The booking may be terminated immediately.
- Quiet hours: No noise or music after 10:00 PM.
- Neighbourhood: Most properties are located in residential areas. Guests agree to respect the privacy and environment of neighbouring residents. Where community rules apply, guests must abide by them.
Repeated violations of house rules may lead to immediate termination of the rental agreement without refund.
11. Keys and Access
All issued keys must be returned in full upon departure. In case of loss or damage, lock replacement costs will be charged to the Guest.
11.1 Lockout
Should you lock yourself out of the property, the following call-out charges apply:

Fees may vary on weekends and public holidays. If a locksmith is required (e.g. keys locked inside), additional charges will apply. Payment must be made before re-entry into the property.
12. Pets
- Pets are only allowed in selected apartments and only with prior written approval at the time of booking.
- A pet surcharge of €20 per pet per month (or part thereof) applies.
- Pets must have complete papers (vaccinations, insurance) where required by law.
- Pets must not roam freely in communal areas. Dogs must be kept on a lead when leaving the property.
- Failure to clean up after your pet or disturbance caused by pets may result in termination of the rental agreement.
13. Equipment and Property Use
- All technical systems (Wi-Fi, electronics, heating, safety equipment) must be used properly. Tampering, misuse, or unauthorised alteration is strictly prohibited and subject to compensation.
- Fire safety equipment is provided in accordance with Austrian safety standards. Misuse will result in replacement charges.
- Guests do not have the right to change the structure, furnishings, or use of any property.
- Where a pool is available as part of the property or community, pool rules must be respected. Children under 12 must not use pools without adult supervision.
14. Safe and Valuables
Not all apartments are equipped with safes. Dwell Bell is not responsible for the loss of cash, documents, or valuables left in the apartment. Guests are advised to take appropriate precautions.
15. Additional Cleaning Services
Additional cleaning services may be arranged and paid as extras. Requests must be made in advance to allow management sufficient time to organise the service.
16. Liability
Guests are fully liable for any damage caused to the property, furnishings, or equipment during their stay. The security deposit will be used for this purpose. If the damage exceeds the deposit, the Guest will be invoiced for the difference.
While reasonable care has been taken to ensure the health, safety, and security of guests, neither BOSU GmbH, the property owners, nor their agents shall be liable for any losses, damage, incidents, accidents, or personal injuries during the rental period or arising from the use of the property, except where such liability cannot be excluded under mandatory Austrian law.
Note: This limitation does not apply in cases of intent or gross negligence, personal injury, or any other liability that cannot be excluded under Austrian consumer protection law (Konsumentenschutzgesetz, KSchG).
17. Property Descriptions
All property descriptions on our website and listings are provided in good faith and are based on regular inspections. In the event of any discrepancy or issue, the Guest is asked to contact Dwell Bell immediately. We will make reasonable efforts to resolve any issues promptly.
18. Right of Entry
The Landlord or authorised personnel may enter the property with prior notice for the purposes of maintenance, inspection, or in case of emergency. In emergencies (e.g. water damage, fire risk), entry may occur without prior notice.
19. Guest Information Requirements
We are required by Austrian law to collect personal information from each guest. After confirming your reservation, you will receive a link to provide your personal details in digital form. This data is processed in accordance with our Privacy Policy (available at https://dwellbell.at/privacy-policy/).
20. Data Protection
Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG). For full details, see our Privacy Policy at: https://dwellbell.at/privacy-policy/
21. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Austria. The competent district court in Vienna shall have jurisdiction, except where mandatory consumer protection provisions require otherwise (e.g. §14 KSchG).
The contract language is German. In case of discrepancy between the German and English versions, the German version shall prevail.
22. Severability
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the original.
23. Acceptance of Terms
By completing a booking (via our website, email, or third-party platform), guests confirm that they have read, understood, and agree to these Terms and Conditions. The current version is available at: https://dwellbell.at/terms-and-conditions/
